Hinweis: Die nachfolgenden AGB regeln das Vertragsverhältnis zwischen Aleksandra Popow (Wedding Mark) und dem Kunden. Im Falle von Abweichungen zwischen der englischen und der deutschen Fassung hat die deutsche Fassung Vorrang.
§ 1 Geltungsbereich und Anbieter
(1) Diese Allgemeinen Geschäftsbedingungen (nachfolgend „AGB“) gelten für alle Verträge, die zwischen Aleksandra Popow (handelnd unter „Wedding Mark“) Basler Str. 1 79639 Grenzach-Wyhlen Deutschland E-Mail: info@wedding-mark.com USt-IdNr.: DE364777110 (nachfolgend „Anbieter“)
und dem Kunden (nachfolgend „Kunde“) abgeschlossen werden.
(2) Das Angebot richtet sich primär an Verbraucher im Sinne des § 13 BGB. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
(3) Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, der Anbieter stimmt ihrer Geltung ausdrücklich schriftlich zu.
§ 2 Vertragsgegenstand und Leistungsumfang
(1) Der Anbieter erstellt für den Kunden eine personalisierte Hochzeitswebsite („Semi-Custom Website“) sowie ergänzende digitale Produkte (z. B. Digital Announcement).
(2) Art der Leistung: Die Website wird auf Basis eines vom Kunden ausgewählten Designs („Template“) erstellt. Der Leistungsumfang umfasst:
Personalisierung des Templates mit den Texten und Daten des Kunden (Typesetting).
Bereitstellung (Hosting) der Website für 12 Monate unter einer individuellen Domain.
Erstellung einer digitalen Ankündigungskarte („Digital Announcement“) als Bilddatei.
(3) Design-Integrität (Fixed Layout): Der Kunde erkennt an, dass das Grundlayout, die Struktur und die typografische Gestaltung des gewählten Templates feststehend sind („Fixed Layout“). Individuelle Anpassungen am Layout oder am Code sind im Grundpreis nicht enthalten, können jedoch gegen gesonderte Vergütung als Zusatzleistung vereinbart werden.
(4) Sprache: Die Erstellung erfolgt in der vom Kunden gewählten Sprache.
§ 3 Vertragsschluss (Inquiry-Modell)
(1) Die Präsentation der Leistungen auf der Website stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer Anfrage („Inquiry“).
(2) Der Vertrag kommt wie folgt zustande:
Der Kunde stellt über das Anfrageformular („Inquire“) eine unverbindliche Anfrage unter Angabe des Termins und der Location.
Der Anbieter prüft die Kapazitäten und sendet dem Kunden per E-Mail ein verbindliches Angebot („Proposal“) oder eine Zahlungsaufforderung.
Der Vertrag kommt zustande, sobald der Kunde dieses Angebot annimmt (z. B. durch Bestätigung per E-Mail oder durch Leistung der Zahlung).
§ 4 Preise und Zahlungsbedingungen
(1) Es gelten die im individuellen Angebot vereinbarten Preise. Sämtliche Preise verstehen sich als Endpreise inklusive der gesetzlichen Mehrwertsteuer.
(2) Soweit nicht anders vereinbart, ist der Gesamtbetrag vor Beginn der Arbeiten fällig (Vorkasse). Der Anbieter ist nicht verpflichtet, mit der Erstellung zu beginnen, bevor der Zahlungseingang verzeichnet wurde.
§ 5 Mitwirkungspflichten des Kunden & Ablauf
(1) Nach Vertragsschluss erhält der Kunde Zugang zu einem Formular oder Leitfaden („Content Guide“), um die erforderlichen Inhalte (Texte, Daten) zu übermitteln.
(2) Fristen für Inhalte: Der Kunde verpflichtet sich, die Inhalte vollständig und in der gewünschten Form bereitzustellen.
Das Dinner-Menü kann bis spätestens einen (1) Monat vor dem Hochzeitstermin nachgereicht werden.
Der Link zur Fotogalerie kann bis zu einem (1) Monat nach der Hochzeit eingepflegt werden. Der Anbieter übernimmt die Einpflege dieser Nachreichungen ohne Aufpreis.
(3) Korrekturschleife: Im Preis ist eine (1) Korrekturschleife („Revision Round“) für textliche Anpassungen enthalten. Weitergehende Änderungswünsche oder nachträgliche Layout-Anpassungen werden nach Aufwand berechnet.
(4) Der Anbieter haftet nicht für Verzögerungen, die darauf beruhen, dass der Kunde seine Mitwirkungspflichten verletzt hat. Für die rechtliche Zulässigkeit der vom Kunden bereitgestellten Inhalte (z. B. Urheberrechte an Fotos) ist allein der Kunde verantwortlich.
§ 6 Hosting, Laufzeit und Domain
(1) Das Hosting der Website und die Domain sind für einen Zeitraum von 12 Monaten ab Freischaltung („Launch“) im Preis enthalten.
(2) Keine automatische Verlängerung: Der Vertrag über das Hosting endet automatisch nach Ablauf der 12 Monate. Eine stillschweigende Verlängerung findet nicht statt.
(3) Verlängerungsoption: Der Kunde hat die Möglichkeit, das Hosting vor Ablauf der Frist um jeweils weitere 12 Monate zu verlängern. Die Kosten hierfür richten sich nach der zum Zeitpunkt der Verlängerung gültigen Preisliste (derzeit 350,00 € inkl. MwSt. pro Jahr). Der Anbieter wird den Kunden rechtzeitig vor Ablauf an diese Option erinnern.
(4) Wird keine Verlängerung gebucht, wird die Website nach Ablauf der 12 Monate offline genommen und die Domain freigegeben.
§ 7 Urheberrecht und Nutzungsrechte
(1) Die Urheberrechte an den Designs, dem Code und den Layouts verbleiben vollumfänglich beim Anbieter.
(2) Der Kunde erhält ein einfaches, nicht übertragbares Nutzungsrecht, die erstellte Website und das Digital Announcement für private Zwecke im Rahmen der geplanten Hochzeit zu nutzen.
(3) Eine Weitergabe der Designs an Dritte zur gewerblichen Nutzung, das Kopieren des Codes (Cloning) oder der Transfer auf andere Server ist ohne ausdrückliche schriftliche Zustimmung des Anbieters untersagt.
§ 8 Widerrufsrecht
(1) Ausschluss des Widerrufsrechts: Gemäß § 312g Abs. 2 Nr. 1 BGB besteht das Widerrufsrecht nicht bei Verträgen zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind. Da die Hochzeitswebsites und Papeterie individuell für den Kunden angefertigt werden (Customized Products), besteht kein Widerrufsrecht.
(2) Erlöschen bei Dienstleistungen: Soweit es sich um Dienstleistungen handelt, erlischt das Widerrufsrecht vorzeitig, wenn der Kunde ausdrücklich zugestimmt hat, dass der Anbieter mit der Ausführung der Dienstleistung vor Ablauf der Widerrufsfrist beginnt, und der Kunde seine Kenntnis davon bestätigt hat, dass er durch seine Zustimmung mit Beginn der Ausführung sein Widerrufsrecht verliert.
§ 9 Gewährleistung und Haftung
(1) Es gelten die gesetzlichen Gewährleistungsrechte.
(2) Der Anbieter gewährleistet, dass die Website zum Zeitpunkt der Übergabe auf gängigen Browsern (Chrome, Safari, Firefox in jeweils aktueller Version) sowie auf Desktop-, Tablet- und Mobilgeräten funktionsfähig ist (Responsive Design).
(3) Für die dauerhafte Verfügbarkeit der Website (Uptime) wird keine Garantie übernommen, sofern Ausfälle auf Störungen beim Hosting-Provider oder höhere Gewalt zurückzuführen sind.
(4) Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit. Bei leichter Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), beschränkt auf den vertragstypischen, vorhersehbaren Schaden.
§ 10 Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
(2) Sollten einzelne Bestimmungen dieses Vertrages unwirksam sein oder werden, so bleibt der Vertrag im Übrigen wirksam.
(3) Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit: https://ec.europa.eu/consumers/odr. Wir sind nicht bereit oder verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
General Terms and Conditions (GTC)
Status: 04.10.2025
Note: The following GTC govern the contractual relationship between Aleksandra Popow (Wedding Mark) and the Customer. This English version is provided for convenience only. In the event of any discrepancies or disputes, the original German version ("Allgemeine Geschäftsbedingungen") shall prevail legally.
§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between: Aleksandra Popow (trading as "Wedding Mark") Basler Str. 1 79639 Grenzach-Wyhlen Germany Email: info@wedding-mark.com VAT ID: DE364777110 (hereinafter "Provider")
and the Customer (hereinafter "Customer").
(2) The offer is primarily directed at consumers within the meaning of § 13 BGB (German Civil Code). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
(3) Deviating terms and conditions of the Customer shall not be recognized unless the Provider explicitly agrees to their validity in writing.
§ 2 Subject Matter and Scope of Services
(1) The Provider creates a personalized wedding website ("Semi-Custom Website") and supplementary digital products (e.g., Digital Announcement) for the Customer.
(2) Nature of Service:
The website is created based on a design selected by the Customer ("Template").
The scope of services includes:
Personalization of the template with the Customer’s text and data (Typesetting).
Provision (Hosting) of the website for 12 months under an individual domain.
Creation of a Digital Announcement card as an image file.
(3) Design Integrity (Fixed Layout):
The Customer acknowledges that the basic layout, structure, and typographic design of the selected template are fixed ("Fixed Layout"). Individual adjustments to the layout or code are not included in the base price but may be agreed upon as an additional service for a separate fee.
(4) Language: The creation will be carried out in the language selected by the Customer.
§ 3 Conclusion of Contract (Inquiry Model)
(1) The presentation of services on the website does not constitute a legally binding offer, but rather an invitation to submit an inquiry ("Inquiry").
(2) The contract is concluded as follows:
The Customer submits a non-binding inquiry via the "Inquire" form, stating the date and location.
The Provider checks capacity and sends the Customer a binding offer ("Proposal") or payment request via email.
The contract is concluded as soon as the Customer accepts this offer (e.g., by confirmation via email or by making payment).
§ 4 Prices and Payment Terms
(1) The prices agreed upon in the individual proposal apply. All prices are final prices including statutory VAT.
(2) Unless otherwise agreed, the total amount is due before work begins (Payment in advance). The Provider is not obliged to commence creation before payment has been received.
§ 5 Customer Cooperation & Process
(1) After the contract is concluded, the Customer receives access to a form or guide ("Content Guide") to submit the required content (text, data).
(2) Deadlines for Content: The Customer agrees to provide the content completely and in the desired format.
The Dinner Menu may be submitted up to one (1) month before the wedding date.
The link to the Photo Gallery may be added up to one (1) month after the wedding.
The Provider will implement these late submissions at no extra charge.
(3) Revision Round: The price includes one (1) revision round for textual adjustments. Further changes or subsequent layout adjustments will be charged based on time and effort.
(4) The Provider is not liable for delays caused by the Customer’s failure to fulfill their cooperation duties. The Customer is solely responsible for the legal admissibility of the provided content (e.g., copyrights for photos).
§ 6 Hosting, Duration, and Domain
(1) Hosting of the website and the domain are included in the price for a period of 12 months from the "Launch".
(2) No Automatic Renewal: The hosting contract ends automatically after the expiration of 12 months. There is no tacit renewal.
(3) Renewal Option: The Customer has the option to extend the hosting before the deadline expires by another 12 months. The costs for this are based on the price list valid at the time of renewal (currently € 350.00 incl. VAT per year). The Provider will remind the Customer of this option in good time before expiration.
(4) If no extension is booked, the website will be taken offline and the domain released after the 12 months have expired.
§ 7 Copyrights and Usage Rights
(1) The copyrights to the designs, code, and layouts remain fully with the Provider.
(2) The Customer receives a simple, non-transferable right of use to utilize the created website and Digital Announcement for private purposes within the scope of the planned wedding.
(3) Passing on the designs to third parties for commercial use, copying the code (cloning), or transferring the site to other servers is prohibited without the express written consent of the Provider.
§ 8 Right of Withdrawal
(1) Exclusion of the Right of Withdrawal: According to § 312g Abs. 2 Nr. 1 BGB (German Civil Code), the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. As the wedding websites and stationery are individually made for the Customer (Customized Products), there is no right of withdrawal.
(2) Expiration for Services: Insofar as services are concerned, the right of withdrawal expires prematurely if the Customer has expressly agreed that the Provider begins executing the service before the withdrawal period has expired, and the Customer has confirmed their knowledge that they lose their right of withdrawal with the commencement of execution.
§ 9 Warranty and Liability
(1) Statutory warranty rights apply.
(2) The Provider warrants that the website is functional at the time of handover on current browsers (Chrome, Safari, Firefox in their current versions) as well as on desktop, tablet, and mobile devices (Responsive Design).
(3) No guarantee is assumed for the permanent availability of the website (Uptime) if outages are due to disruptions at the hosting provider or force majeure.
(4) The Provider is liable without limitation for intent and gross negligence. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal duties), limited to the typical, foreseeable damage.
§ 10 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
TERMS AND CONDITIONS FOR BESPOKE WEDDING STATIONERY

1. Scope and Subject of the Terms
(1) The following provisions apply to all agreements for bespoke wedding stationery between Aleksandra Popow, trading as Wedding Mark, and the client.
(2) These terms outline the design and production of bespoke wedding stationery, as well as any agreed-upon services.
2. Services Offered- We provide bespoke designs for:
- Save-the-date cards
- Invitations
- Menu cards
- Day-of items (e.g., place cards, table numbers, table plan, welcome sign)
- Additional items, such as thank-you cards or other non-standard elements, can be added to your package.
We are open to unique requests and custom additions.
- Our services are available exclusively as part of a full-service package, starting with save-the-dates, invitations, and day-of items. Follow-up services, such as wedding websites, can be included upon request.
- Additional items requested beyond the standard list will be quoted separately.
3. Booking and Initial Consultation
- To reserve our services, full payment of the flat design fee is required.
- Once booked, we will arrange a video consultation to discuss your vision, preferences, and specific details. This step ensures clear communication and alignment.
- After the consultation, a contract and detailed questionnaire will be provided. The questionnaire collects all necessary information to begin the design process.
- Work begins upon receipt of the signed agreement and completed questionnaire.
4. Payment Terms
- The flat fee for the design phase is payable upfront and is non-refundable.
- The flat fee covers the creation of concepts and designs for all full-service package items.
- Any additional non-standard items requested will be quoted separately and billed upon project completion.
- Production costs are calculated and invoiced separately, with full payment required before production begins.
5. Design Process
- Once all necessary information is received, including mood boards or stationery inspirations, the design process will begin
- We will present 2-3 initial concepts for your review
- Revisions will be made based on your feedback until the final design is approved.
6. Production
- Production begins only after final design approval. Timelines depend on the complexity of the project and the selected materials and techniques (e.g., letterpress, embossing, foil stamping).
7. Delivery
- We provide secure shipping services, with timelines and costs depending on your location.
- Stationery is carefully packaged to ensure it arrives in perfect condition.
- Direct mailing services for save-the-dates, invitations, and thank-you cards are available upon request and will be quoted separately.
8. Changes and Cancellations
- Changes to the design after final approval may incur additional fees and extend the timeline.
- Cancellations are non-refundable, covering services rendered up to that point.
9. Sustainability
- We prioritize eco-friendly materials and collaborate with responsible suppliers to minimize environmental impact.
- For every order, we plant a tree through a dedicated foundation to support a sustainable future.
10. Timelines
- Key milestones for the design process include:
- Save-the-dates: Start of design and submission of all required content by [Date].

- Day-of items: Start of design and submission of all required content by [Date].
- Thank-you cards: Start of design and submission of all required content by [Date].
- Production timelines depend on materials and techniques and will be outlined after design approval.
- Start dates for design are non-negotiable. Delays in providing required content may result in additional fees.
11. Intellectual Property
- All designs remain the intellectual property of Aleksandra Popow and may not be reproduced or used for other purposes without written consent.
12. Liability
- We are not liable for delays caused by factors outside our control, such as shipping or supplier issues.
- It is your responsibility to carefully review all proofs. We are not responsible for errors approved in the final design.
13. Force Majeure
- Neither party shall be held liable for delays or failure to fulfill obligations due to events beyond reasonable control, such as acts of God, illness, pandemics, or government restrictions.
- In such cases, both parties agree to communicate promptly and work towards a resolution. If the contract cannot be fulfilled, services rendered up to that point will be billed accordingly.

2. Services Offered
Our bespoke wedding website packages are crafted to reflect each client’s unique needs and vision.
The basic package includes:
Fully custom wedding website design and development tailored to the client’s specifications.
Standard features:
Pages for Home, Our Story, Travel & Stay, Timeline, FAQs.
RSVP form redirecting responses to email.
Editable updates section for announcements.
Custom domain setup.
Unlimited creative possibilities with optional features, such as:
Guest management integration.
Interactive map links.
Additional personalized pages or functionalities upon request
3. Initial Consultation and Agreement
A video consultation will be arranged to discuss the client’s vision, preferences, and specific details for their wedding website. Following the consultation, a contract and a detailed questionnaire will be provided. The questionnaire collects all necessary information to begin the design process. Work will commence upon receipt of the signed agreement and completed questionnaire.
4. Design and Development Process
After receiving all required materials (e.g., mood boards, content, functional requirements), the design process will begin. A draft concept will be presented to the client for review and feedback, with necessary revisions to finalize the design. Upon design approval, the development phase will commence to create the live website.
5. Delivery
The completed website will undergo thorough testing for functionality, design accuracy, and responsiveness. The final product will be delivered as agreed, with training provided for clients requiring assistance with basic functionalities.
6. Hosting, Content Management, and Maintenance
Each bespoke website includes one year of hosting, starting from the launch date, as well as a custom domain. Content updates are exclusively managed by Wedding Mark. Clients may request text or content changes up until their wedding day, with a standard processing time of approximately 7 business days per update (longer during peak wedding season).
Additional maintenance or post-wedding updates can be arranged under separately agreed terms.
7. Payment Terms
The project’s cost is determined individually following the initial consultation.
A flat fee is required upfront to begin the project.
Non-standard elements or additional requests introduced during the process will be quoted separately and billed upon project completion.
8. Changes and Cancellations
Changes to the design or functionality after final approval may incur additional fees. Cancellations are non-refundable and cover services rendered up to the point of cancellation.
9. Intellectual Property
All designs, website code, and related intellectual property remain the exclusive property of Aleksandra Popow and may not be reproduced, distributed, or used without written consent.
10. Liability
Wedding Mark is not liable for delays caused by external factors, such as hosting platform issues or third-party service interruptions.
Clients are responsible for providing accurate and complete content for their websites.
11. Force Majeure
Neither party will be held liable for delays or failure to fulfill obligations due to events beyond their reasonable control, such as natural disasters, government restrictions, or technical failures.
In such cases, both parties will communicate to reach a fair resolution.
